On 24 April 2025, the UK's Serious Fraud Office("SFO") launched new guidance for corporates on self-reporting,cooperation and deferred prosecution agreements("DPAs"). Among other things, the newguidance states that, if a corporate self-reports suspectedwrongdoing and co-operates fully with investigators, it can expectto be invited to negotiate a DPA rather than face prosecution,unless exceptional circumstances apply.

Last month, the High Court ruled that planning permission previously granted for a coal mine in West Cumbria was unlawful (Friends of the Earth v West Cumbria Mining [2024] EWHC 2349 (Admin) ("West Cumbria Mining")). West Cumbria Mining is the first English case to be decided on fossil fuel development since the Supreme Court's ruling in Finch v Surrey County Council [2024] UKSC 20 ("Finch") earlier this year.

On 18 September 2024, the UK Supreme Court ("UKSC") issued its reasoned judgment in UniCredit Bank GmbH v. RusChemAlliance LLCafter unanimously dismissing an appeal by Russian company, RusChemAlliance LLC ("RCA") against an order of the Court of Appeal requiring RCA to cease court proceedings it had commenced in Russia against UniCredit on the basis that the parties had agreed in their English-law-governed bonds to resolve disputes by arbitration under ICC Rules with a Paris seat.

On 26 October 2023, the Economic Crime and Corporate Transparency Act 2023 (the "Act" or "EECTA") received royal assent and became law. The Act introduced a number of changes, some of which came into effect immediately and others which are still due to be implemented.
