The High Court has determined questions of case management and disclosure following on from its previous ruling (considered here) that group claims against Shell Plc and its Nigerian subsidiary relating to oil contamination in the Niger Delta must proceed as "global claims", in light of the claimants' failure to identify the particular spills said to have caused each claimant's loss: Alame v Shell Plc [2024] EWHC 510 (KB).

The High Court has refused to strike out a group action brought against Shell Plc and its Nigerian subsidiary in connection with oil contamination in the Niger Delta. The court rejected the defendants' argument that the claims should be struck out due to a failure to identify the particular oil spills alleged to have caused each claimant's loss.

A recent Supreme Court decision has confirmed the orthodox position in relation to how the law of limitation applies to claims in private nuisance, in particular as to when there will be a "continuing nuisance" such that the limitation period starts afresh from day to day. This has significant implications for environmental claims which are framed in private nuisance and based on a one-off escape of a polluting substance: Jalla v Shell International Trading and Shipping Co Ltd [2023] UKSC 16.
