In a decision dated 12 November 2024 the Court of Appeal
("CoA") of the Unified Patent Court has clarified that
Art. 83(4) UPCA must be understood to mean that an earlier opt-out
cannot effectively be withdrawn if an action has been brought
before the national court at any time during the transitional
period (i.e. on or after 1 June 2023). Proceedings that were
brought prior to the transitional period, whether still pending or
not, do not stand in the way of an effective withdrawal of an
opt-out.

On 4 June 2024 the UPC Court of Appeal provided their first
decision on the validity of opt outs in the case of Neo
Wireless v Toyota (UPC_CoA_79/2024)1. The Court
confirmed that for an opt out to be valid and effective it must be
filed by or on behalf of all proprietors of
all of the national parts of the European
patent.
In the case at issue, an opt out had been filed by Neo Wireless
LLC ('Neo USA') on 30 March 2023, before grant of the
application.

Today, 1 September 2024, Romania joins the Unitary Patent
system. This is the first territorial extension of the Unitary
Patent since it began in 2023. The addition of Romania increases
the number of EU Member States in the Unitary Patent system to 18
and adds a market of 19 million people to the coverage of a Unitary
Patent.

UPC's first ever full judgement on an infringement action in
the case of Franz Kaldewei GmbH & Co. KG v. Bette GmbH
& Co. KG.
The case related to EP 3 375 337 for mouldings for shower trays. Franz Kaldewei GmbH & Co. KG ("Kaldewei"), the patent
proprietor and plaintiff, sued Bette GmbH & Co. KG
("Bette") for infringements in Austria, Belgium, Denmark,
France, Italy, Luxembourg and the Netherlands.

Introduction In situ treatment commonly involves the creation of a reactive zone by injecting a reagent into the subsurface, which leads to the mass destruction of contaminants. Examples of such in situ treatment methods include chemical oxidation (Siegrist et al. 2016) and enhanced bioremediation (Reinhard et al. 1997). In these injection-driven remedial technologies, the design of an effective delivery system is a key requirement for success.
