A new rule issued by the Department of Labor earlier this year is making some freelancers nervous, so much so that a few are challenging it with lawsuits. The rule offers new guidance on how the agency will determine if a worker is an employee or an independent contractor under the Fair Labor Standards Act. That didn’t work out so well for publishers, many of whom had hired expensive video teams and found they had to row back after interest waned. But now social platforms are going “all-in” on video again as they increasingly compete with each other for attention in a more fragmented and uncertain landscape.
