Immigrants in removal proceedings who know their hearings are going to end badly may be able to salvage their situation by requesting voluntary departure. They would still have to leave the U.S., but they wouldn’t be deported. It’s an important distinction: Deportation would bar them from entering the U.S. lawfully for between five and 20 years. Voluntary departure, which carries no such sanction, might be a benefit not only to the immigrant, but also to President Trump.

The current administration is very serious about enforcing our immigration laws, and unlike the previous administration, it has not placed any restrictions on which provisions can be enforced. As border czar Tom Homan has said, “We’re enforcing the laws that Congress enacted and a president signed.” Most of the provisions in the Immigration and Nationality Act pertain to civil offenses, such as deportability and eligibility for relief from deportation.

Rep. Mike Collins (R-Ga.) introduced the Laken Riley Act to “give local law enforcement and ICE more tools to fight illegal immigrants who commit crime in the United States.” It was named after a 22-year-old nursing student murdered by an undocumented immigrant. The act passed in the House with 251 yeas and 170 nays. Sen. Katie Britt (R-Ala.) introduced an identical version in the Senate, where it also passed, 64 to 35.

Democrats have introduced 20 versions of a DREAM Act that would make lawful status available to undocumented immigrants who were brought here by their parents when they were young children. None of their DREAM Acts got the Republican support needed to make it through the legislative process.  Was the problem that Republicans didn’t want to help DREAMers? I don’t think so.

According to political reporter Aaron Blake, President-elect Donald Trump may separate more children from their parents in his second term than he did in his first. Around 4.4 million U.S. citizen children live with the 11 million undocumented parents Trump wants to deport en masse. According to the Pew Research Center, these children account for approximately 84 percent of the children in the U.S. who live with an undocumented parent.
