[co-author: Jumana Rahman]The Civil Procedure Rules (“CPR”) have been amended to reflect the Court of Appeal decision in Churchill v Merthyr Tydfil County Borough Council [2023] EWCA Civ. 141. The courts in England and Wales can now order parties to engage in alternative dispute resolution (“ADR”) where such an order is proportionate and does not undermine the parties’ right to a judicial hearing.

Introduction Equity investment in FinTech has expanded rapidly over the past decade – amounting to over $1 trillion in more than 35,000 deals from 2010 to 2021 – and has been described as a FinTech boom (Cumming and Schwienbacher, 2018). This expansion far outpaces the growth of non-FinTech investment, with capital raised by FinTech companies reaching 5% of the value of global equity deals in 2020, up from less than 1% in 2010 (Cornelli et al., 2021).
