Concerns that artificial intelligence (AI) systems pose serious risks for public safety have caused legislators and other policymakers around the world to propose legislation and other policy initiatives to address those risks. One bold initiative in this vein was the California legislature’s enactment of SB 1047, the Safe and Secure Innovation for Frontier Artificial Intelligence Models Act, in late August 2024.

The fair use limitation on the scope of authorial exclusive rights is expected to be the main defense in lawsuits charging generative AI developers with copyright infringement. Some authors and artists strenuously object to the ingestion of their works as training data for foundation models that power generative AI and to outputs, such as texts and visual art, which they claim unfairly compete with their human creations.
