The government has confirmed that women and their partners in the UK who suffer a miscarriage before 24 weeks of pregnancy are to be granted a right to bereavement leave of two weeks. Under existing law, bereavement leave only applies where parents have suffered a stillbirth after 24 weeks of pregnancy, or the loss of a child.

The overall content of the Bill has not changed significantly. The most noteworthy amendment, if passed, would extend the time limit for issuing most types of Employment Tribunal claims from three to six months.

Following the passing of the Neonatal Care (Leave and Pay) Act in 2023, the Government has confirmed that, subject to Parliamentary approval, a day one right to neonatal leave for working families with babies in neonatal care will be introduced from 6 April 2025. Neonatal Care Leave will apply to parents of babies who are admitted into neonatal care up to 28 days old and who have a continuous stay in hospital of 7 full days or longer.

The newly published Employment Rights Bill strengthens the new duty on employers to prevent sexual harassment in the workplace coming into force on 26 October 2024. Employers will already be subject to a new mandatory duty to take “reasonable steps” to prevent sexual harassment in the workplace. If the employer fails to take these reasonable steps, and an employee is successful in a claim for sexual harassment, the employer will be subject to an uplift of up to 25% of the compensation awarded.
