Litigators on both sides of the claimant/defendant divide will have been poring over the detail of the Civil Justice Council’s report into litigation funding, published at the start of June. The wide-ranging proposals cover a huge amount of ground. From a litigation perspective, one particularly interesting suggestion is that successful funded claimants should be able to recover their funding costs from defendants in ‘exceptional’ cases. What would count as exceptional?

A high-powered Court of Appeal case heard submissions yesterday in a crunch issue for the litigation funding industry. In Commercial and Interregional Card Claims Ltd v Mastercard and others, the chancellor of the High Court Sir Julian Flaux, deputy head of civil justice Lord Justice Birss and Lord Justice Green will rule on the validity of litigation funding agreements (LFAs) based on a multiple of funding provided.

The Supreme Court ruling which two years ago threw litigation funding into chaos should be reversed by legislation ‘as soon as possible’, the Civil Justice Council has recommended in its final report on the sector, published today. The CJC recommends a ‘twin-track’ approach that prioritises the reversal of PACCAR through legislation that should be ‘both retrospective and prospective’ in effect.

The Civil Justice Council today recommended the reversal of the Supreme Court’s PACCAR ruling ‘as soon as possible’. In its final report on the litigation funding sector, it recommends the effect of PACCAR be reversed by legislation that should be ‘both retrospective and prospective’ in effect. The CJC also recommends separate primary legislation to bring about a number of other measures.
