Claimant lawyers have seen off a significant threat to the future of litigation funding in opt-out class actions in the Competition Appeal Tribunal, with victory in a Court of Appeal ruling handed down today. In Gutmann v Apple Inc & Ors, the CoA judges unanimously confirmed thatlitigation funders can take their fee before any damages are distributed to class members.

The litigation funding industry is fighting on several fronts. As the Gazette has reported, the battle is far from limited to the Civil Justice Council’s review of the sector, which may lead to unwelcome changes such as more onerous regulation, caps on funders’ returns and a new duty for parties to disclose the presence of funding. At least as concerning for funders is a key hearing looming in the Court of Appeal, due to be heard before the end of July.

The senior judiciary is on the lookout for a magic money tree. The April 2013 Jackson reforms sought to get a grip on legal costs through proportionality and costs budgeting. Unfortunately for claimants, however, they also put an end to recoverable success fees and after-the-event insurance premiums. That has damaged the ability of lawyers to act under ‘no win, no fee’ agreements, and left many people unable to access the courts.

The regulatory framework for litigation funding is ‘out of step with the commercial realities’ and ‘urgent reforms’ are needed, according to a network of class representatives chaired by Walter Merricks CBE. A submission to the Civil Justice Council’s review of litigation funding by the Class Representatives Network (CRN), based on evidence from around half of its 42 members and written by its legal and policy officer Rhea Gupta, highlights the network's concerns.
