We were so pleased to have the opportunity to address
InformaMarkets' 13th Annual Pharma IPR
Conference in Mumbai on legal challenges to polymorph
patents. Patents covering one or more crystalline forms of a
drug substance at times have presented steep obstacles to generic
drug manufacturers' efforts to enter the market. As we
sought to make clear through our presentation, however, polymorph
patents are of varying strength and susceptible to both
noninfringement and invalidity challenges.

patentable subject matter pursuant to 35 U.S.C. § 101 under
Alice. This case underscores the difficulty that courts
face in applying the judicially created exceptions to §
101's patent eligibility criteria.

unique infringement issues. Because generic drug manufacturers
typically do not treat patients, patentees frequently allege
induced or contributory infringement. The Federal Circuit's
precedential opinion in H. Lundbeck A/S v. Lupin Ltd. narrows
the grounds on which brand product manufacturers can allege
infringement of method of treatment patents, particularly when the
ANDA applicant seeks approval for "skinny" labeling.
