To avoid potential risks to investor protection, as well as to financial stability within the European single market, the Regulation on Markets in Crypto-assets (MiCAR) is about to introduce a harmonised and dedicated set of rules governing the activities carried out by crypto-asset service providers (the so-called CASPs), as well as a passporting procedure to facilitate the performance of these services within the EU on a cross-border basis or through the right of establishment.

The EU is harmonising the rules on the prudential supervision of EU branches of non-EU banks under CRD VI. The new EU-wide third country branch regime will introduce minimum requirements including capital and liquidity requirements, internal governance obligations and rules on outsourcing management. CRD VI will further establish a tiering system for third country branches based on the size and activities and a subsidiarisation power for systemic branches.

Final provisions on cross-border banking services in the EU publishedCRD VI will bring in uniform minimum prudential requirements for third country branches providing banking services in the EU and, more importantly, introduces a ban for third country institutions providing core banking services (lending, guarantees and commitments and deposit-taking) into the EU on a cross-border basis. The provision of cross-border investment services as such remains unaffected.

The ESRB has published a speech by Christine Lagarde, President of the ECB and Chair of the ESRB, on its first general warning about financial stability risks that it published in September last year. The ESRB considers that the general warning has indeed proved impactful over the past year and that it has worked towards reducing policymakers’ “inaction bias” with regard to the implementation of macroprudential policy.
