중국에서 특허권의 존속기간은 출원일부터 20년이다. 현행 전리법 제42조 제2항에는 특허권 존속기간 보상제도가 도입되었다. 즉, 특허출원의 등록 과정에서 지연된 기간은 특허권 존속기간에서 보상을 받는 제도이다. 이하, 이 제도를 간략하게 소개하도록 한다. 1. 존속기간 보상청구의 제출특허권자는 특허등록공고일부터 3개월 내에 국무원전리행정부문에 존속기간보상청구를 제출하고 비용을 납부해야 한다. 상기 비용에 대하여 지금까지 중국국가지식재산권국(CNIPA)에서 아직 명확한 규정을 발표하지 않았다. 2. 보상기간의 계산방법보상기간은 특허등록과정에서 불합리하게 지연된 실제 일수에 따라 계산한다. 구체적으로, 특허출원일부터 만 4년으로서 심사청구일부터 만 3년이 되는 날부터 특허등록공고일까지의 일수에서 합리적인 지연 일수와 출원인의 원인으로 인해 비합리적으로 지연된 일수를 덜어낸 일수이다. 특허권 존속기간의 보상은 최장 보상기간을 한정하지 않았다.

On the day of my interview, they told me I would receive my results within six weeks. That Wednesday was the sixth week.
