The White House issued the Framework as a follow up to a COP28 announcement, where the U.S. and a number of other countries committed to triple the use of nuclear energy by 2025 (which we wrote about here). The Framework calls for tripling U.S. nuclear capacity by 2050 to meet U.S. energy needs, including for reliable and clean energy, and to support U.S. economic opportunity and national security interests.

Of the three, data centers are the leading contributor to this projected demand increase—with their growth predominately driven by the emergence of generative AI, which needs major data processing capabilities and—as a result—consumes a large amount of electricity.

In its July 18, 2024 memorandum (SRM-SECY-24-0032), the Commission issued a decision that would change the process for conducting mandatory hearings and which is expected to shorten the total timeline for conducting such hearings from 4 months to about 8 weeks. The Commission would remain the presiding officer for all mandatory hearings except those for licenses for uranium enrichment facilities, which will be delegated to the Atomic Safety and Licensing Board Panel (“ASLBP”).

The Accelerating Deployment of Versatile, Advanced Nuclear for Clean Energy Act”—or ADVANCE Act—passed Congress in June. With President Biden’s signature, this comprehensive legislation has become law. The Act’s advancement into law reflects an overwhelming bipartisan support for nuclear energy across the branches of government. We have covered this bill for a while now as it has moved through Congress in various iterations.

The biggest impact is anticipated to come from the Supreme Court overturning the Chevron deference doctrine. Under Chevron, which has been in place for 40 years, if a statute is unclear or ambiguous, courts would typically defer to an agency's reasonable interpretation rather than substituting their own judgment. This type of deference is no more. Instead, courts must apply their independent judgement in determining whether an agency acted within its statutory authority.

Russia and U.S. nuclear fuelIn mid-May, the President signed into law a Russian uranium ban, which also unlocks funding for $2.72 billion to rebuild the U.S. nuclear fuel supply chain, and there is pending legislation on the Hill that would put in place a comprehensive ban on activities involving ROSATOM, Russia's state nuclear energy corporation. Russia plays a dominant role in nuclear fuel.
