ABSTRACTBetween 2017 and 2022, the U.S. Supreme Court examined three cases that involved states that tried to limit the use of public money to support religious-affiliated schools. The Supreme Court found a violation of the Free Exercise Clause in all three cases. Although not the focus of the Court’s opinions, these cases may have created avenues for discriminatory practices in publicly funded state school voucher programs.

This school will be the first religious charter school approved in the nation. Many were shocked to learn that there could be a religious charter school—after all, it is widely accepted that charter schools are public schools.

When the case came before the Supreme Court in 1982, the justices agreed to analyze whether the school board’s decision to bar certain books from its libraries, based on the books’ content, violated the students’ rights. The ruling was divided – five justices affirmed the appeals court’s decision in favor of the students, though not all of them agreed on exactly why.
