Bislang war der bevorzugte (weil: verhältnismäßig einfachste) Weg zur Legitimation solcher Datenexporte die Vereinbarung von Standardvertragsklauseln im Sinn von Art. 46 Abs. 2 (c) DSGVO („SCC“). Die meisten Unternehmen werden also aktuell zur Legitimation ihrer Datenexporte dieses Instrument vereinbart haben. Da nun mit dem „DPF“ eine weitere Möglichkeit ergibt, stellt sich die Frage: welches Instrument soll man nun nutzen – SCC oder DPF?

Since July 10, 2023, the adequacy decision based on the “EU/US Data Privacy Framework” (“DPF”) provides a new possibility to legitimize data exports to the USA. Until now, the preferred (because: relatively easiest) way to legitimize such data exports was to agree on the Standard Contractual Clauses (“SCC”) in accordance with Article 46 (2) (c) GDPR. Accordingly, Most companies will therefore currently use SCC as means to legitimize their data exports.

As reported, on July 10, the European Commission issued an adequacy decision based on the Data Privacy Framework (“DPF”). This is important news as it opens up a new way to legitimize data exports from the EU to the US. As a reminder, since the ECJ’s “Schrems II” ruling, the most commonly chosen (because relatively easiest) way to legitimize data exports to the U.S. has been to agree to standard contractual clauses in accordance with Article 46 (2) c GDPR (“SCC”).
