I knew “The Morrison Game Factory” had its hooks in me when I started talking back to it. There I was, alone and at home, and in conversation with a fictional machine. Puzzles were sprawled around me. Colorful dice, a small board, little plastic rocket ships and a stack of cards with seemingly disconnected drawings on them — a golfer, a mushroom, a diver and more. I was about two hours into Lauren Bello’s puzzle game, but I was devouring it more as a story.

As we await the Supreme Court’s decisions in Relentless and Loper Bright, left-leaning scholars and activists have bemoaned the demise of Chevron deference as harmful to progressive values. But this is not true in at least one area of law: banking. Where Congress enacted incredibly progressive statutes, courts granted Chevron deference to regulators’ interpretations in ways that systematically undermined Congress’s intent and ultimately helped cause the 2007–08 Great Financial Crisis.

Earlier this week, Max Sarinsky published an excellent piece about how agencies could get ahead of major questions doctrine (MQD) challenges to new rules. That blog post, which drew heavily from Sarinsky’s new law review article with Richard Revesz, argues that agencies should follow the lead of the Environmental Protection Agency and articulate specific regulatory antecedents to counter allegations that their rules violate the MQD.
