In late August, a lawsuit was filed in Texas seeking to block the Biden-Harris Administration from enforcing provisions of a recent regulation setting new standards for short-term, limited duration health insurance (STLDI) policies and requiring expanded disclosures to consumers for STLDI and fixed indemnity insurance. The case has been assigned to Sean D. Jordan, a Trump appointee.

On August 29th, 2024, TrueCoverage, LLC (TrueCoverage) and Benefitalign LLC (Benefitalign), two online entities supporting enrollment in the Affordable Care Act (ACA) Marketplaces, sued the U.S. Department of Health and Human Services and Centers for Medicare & Medicaid Services (CMS) following their suspension by federal officials. On the same day, the plaintiffs moved for emergency relief—a temporary restraining order (TRO) and preliminary injunction to block the suspension.

A group of 19 Republican state attorneys general, led by Kris Kobach of Kansas, recently brought a lawsuit challenging the new HHS rule that extends access to health coverage to Deferred Action for Childhood Arrivals (DACA) recipients. A previous Health Affairs Forefront article explained the rule in more detail. The lawsuit, which was filed in a federal district court in North Dakota on August 8, 2024, but then amended on August 28, has been assigned to Judge Daniel M. Traynor, a Trump appointee.
