In choosing to raise employers’ national insurance contributions as the main mechanism to raise taxes the Chancellor Rachel Reeves took a wrong turn. National insurance is a tax on employment. Increasing it will other things being equal reduce employment or even worse make smaller organisations unviable. It was also an attack on business especially those dependent on workers at the lower end of the pay scale.

I find that HMRC have changed their views about the taxation of lump sums on divorce (see also ‘Private client review for April’, Tax Journal, 25 April 2025). It is well known that TCGA 1992 s 59 provides that transfers of assets between spouses take place at a value giving rise to no gain and no loss, and that this treatment continues to apply for three years after the tax year in which they cease to live together. After the end of that period, the normal CGT rules apply.

As part of the Government’s Tax Update Spring 2025, HMRC have confirmed they will bring forward their proposals for reform broadly as outlined in their consultation, with some modifications:The purchaser will be liable for the tax but the online portal will allow agents to be the ‘accountable person’ for paying the tax.

The ‘no disqualifying arrangements requirement’ (ITA 2007 s 178A) was introduced into the Enterprise Investment Scheme (EIS) legislation by FA 2012 and applies to all EIS shares that have been issued since 6 April 2012. It was introduced as anti-avoidance legislation to target arrangements which the Government saw arguably rightly as outside the spirit of the legislation.

In B Lynch v HMRC [2025] UKFTT 300 (TC) (10 March) the First-tier Tribunal (FTT) upheld discovery assessments of just under £10m on individual steps in a failed avoidance scheme where overall there was no economic advantage. Individual steps could not be ignored where these resulted in tax being chargeable. The taxpayer participated in a marketed tax avoidance scheme for 2010/11 to 2013/14. The scheme was notified under DOTAS.
