Abstract In this work we challenge the argument for robot rights on metaphysical, ethical and legal grounds. Metaphysically, we argue that machines are not the kinds of things that may be denied or granted rights. Building on theories of phenomenology and post-Cartesian approaches to cognitive science, we ground our position in the lived reality of actual humans in an increasingly ubiquitously connected, controlled, digitized, and surveilled society.

In seeking legislation to allow the use of facial recognition technology (FRT) in policing, Ireland risks introducing a technology that scientific evidence has demonstrated is ineffective, inherently flawed, opaque and discriminatory. Rights and civil liberties advocates across the globe have formed coalitions to warn of its dangers. If Ireland goes ahead with this controversial technology, it is a matter of time before the country finds itself in another cautionary international headline.

We are currently witnessing an AI boom. Generative AI particularly has captivated the general public, the scientific community, journalists, and legislators. The launch of Dall-E in April 2022, which purportedly attracted over a million users within the first three months of release pushed generative AI into the mainstream. It was followed by the release of Midjourney in July and Stable Diffusion in August the same year and subsequently, the launch of ChatGPT in November 2023.
