On April 15, 2024, the U.S. Department of Justice announced a new Pilot Program on Voluntary Disclosures for Individuals, which grants fully-cooperating individuals who self-disclose "original information about criminal misconduct" the prospect of a non-prosecution agreement ("NPA"). This pilot program fills a gap left by the agency's recently announced whistleblower rewards pilot program, the latter of which applies to non-participating informants (refer to our recent article on this program).

Resolving a split among the circuit courts, the U.S. Supreme Court has issued a unanimous decision in Macquarie Infrastructure Corp. v. Summary The U.S. Supreme Court has issued two major decisions on the False Claims Act ("FCA") this month. In United States ex rel. Schutte v. SuperValu, Inc. and United States ex rel. Proctor v. Safeway, Inc., the Court rejected an "objective reasonableness" knowledge standard in cases where the false claim is based on an alleged misrepresentation of compliance with an ambiguous legal requirement, in favor of one based on the defendant's subjective belief about that requirement.
