The New York State Education Department (“NYSED”) recently released a “Formal Opinion of Counsel” regarding the number of instructional hours school districts must provide to students who are suspended from school. Education Law § 3214(3)(e) requires that a student of compulsory school age who is suspended from school receive alternative instruction. Such instruction must be substantially equivalent to that received by the student prior to the suspension.
