    The New York State Education Department (“NYSED”) recently released a “Formal Opinion of Counsel” regarding the number of instructional hours school districts must provide to students who are suspended from school. Education Law § 3214(3)(e) requires that a student of compulsory school age who is suspended from school receive alternative instruction. Such instruction must be substantially equivalent to that received by the student prior to the suspension.

    EARLIER THIS YEAR, Walter De Maria’s Earth Room, which had been closed for a monthslong period of maintenance, was reopened to the public. Officially known as The New York Earth Room, the work is owned and maintained by the Dia Art Foundation. It became a permanent installation in 1980 and—but for annual summer closures and, of course, a pandemic shutdown—has been open continuously since then.

    New York State recently updated the Commissioner’s Regulations related to providing homebound instruction for kindergarten through age 21 students. Homebound instruction is temporary education, typically provided in the form of tutoring, to students who are medically unable to attend school and are either restricted to their homes or placed in hospitals or other institutions.

    Kenosha Unified has seen much change this past year. As an organization, we continued to work our way out of a pandemic, faced a deficit budget, and had another change in leadership. While these are major items, none of them stopped our organization from providing high quality education to the students of our community. I am happy to share that just over four months into my role as the superintendent of KUSD I am seeing many great things happening in our schools.
