The U.S. Equal Employment Opportunity Commission (EEOC) issued proposed regulations for the Pregnant Workers Fairness Act (PWFA). The PWFA requires employers with 15 or more employees to provide reasonable accommodations to support employees or applicants with a known limitation related to, affected by or arising out of pregnancy, childbirth or related medical conditions, unless the accommodation will cause the employer an undue hardship. The law took effect on June 27, 2023.

The New York Legislature passed a bill (A01278/S3100A) that would prohibit noncompetition agreements between employers and employees by adding a new Section 191-d to the New York Labor Law. If it is signed into law by Gov. Kathy Hochul, New York will become the fifth state, after California, North Dakota, Oklahoma, and Minnesota, to ban virtually all noncompete agreements.

On May 26, 2023, Mayor Eric Adams signed into law a bill that expands New York City anti-discrimination laws by adding an individual’s height and weight to the list of protected characteristics under the New York City Human Rights Law. This new law becomes effective on Nov, 22. 2023 and prohibits discrimination in employment, housing and public accommodations on the basis of an individual’s height and weight.
