I am grateful to Law & Liberty for publishing this forum on New York Times v. Sullivan and the meaning of the First Amendment. I also wish to thank the other contributors for the thought and care they put into their responses to my critique of the Sullivan doctrine. Their arguments help to clarify the issues involved in this important matter. I will try to address their principal points as thoroughly as I can, moving from the less radical to the more radical criticisms.

November 20, 2024 The Supreme Court may be able to address the worst consequences of Sullivan without overturning the decision outright. There’s a case to be made against the Supreme Court’s landmark 1964 decision in New York Times v. Sullivan, and Carson Holloway makes it. Sullivan, despite a bit of handwaving in the majority opinion, represented a drastic departure from previous law, one without any particular warrant in the Constitution.

Disparity studies comparing various demographic groups based on different outcomes in education, employment, health, housing, and income have been a staple of public policy analysis for decades. In the summer of 2022, something extraordinary happened in America’s modern constitutional history. The Supreme Court, in Dobbs v. Jackson Women’s Health Organization, reversed its earlier creation, in Roe v. Wade, of a constitutional right to abortion. By this ruling, the Dobbs Court destroyed a key assumption that had come to govern our thinking about the trajectory of American constitutional law since the rise of modern judicial activism.
