    In VLM v. Dominey Estate, 2023 ABCA 261, the Alberta Court of Appeal overturned the Alberta Court of King's Bench in VLM v. Dominey, 2022 ABQB 299. The lower court denied certification of a proposed class action against the Alberta government and the Synod of the Diocese of Edmonton for the actions of a deceased priest who allegedly committed sexual assaults against youth inmates in a correctional facility between 1985 and 1989.

    In Abbott Laboratories, Ltd. v Spicer, the Saskatchewan Court of Appeal permanently stayed a proposed class action that was the last of five proposed national class actions concerning the drug sibutramine. The Court held that permitting serial attempts at certification in multiple jurisdictions was an abuse of process and contrary to access to justice. Spicer emphasizes that access to justice “does not require that every prospective class action advance to a certification hearing” (para 82).

    SCC Rejects Data Breach Class Action Appeals August 9, 2023 On July 12th, 2023, the Supreme Court of Canada denied leave to appeal to the plaintiffs in four land-mark data breach class actions: Setoguchi v Uber from the Alberta Court of Appeal, and  Owsianik v Equifax, Winder v Marriot and Obodo v Trans Union from the Ontario Court of Appeal.
