Schedule III drugs are defined as having moderate to low potential for psychical and psychological dependence, and have less abuse potential than Schedule I. Cannabis will remain a Schedule I controlled substance until after a final rule is published. Any member of the public can submit their opinion on the rule to assist the DOJ in making a determination about the appropriate schedule of cannabis.

A group of telehealth leaders have written a letter to the DEA requesting that the geography “red flag” be explicitly addressed in the upcoming telehealth rulemaking. Current processes prevent many pharmacists from filling prescriptions for controlled substances when the prescriber and patient are not in the same geographic area — which is an increasing concern as telehealth retains its popularity after the pandemic.
