On July 26, 2024, the National Labor Relations Board
("NLRB" or "Board") issued a final rule (the
"2024 Rule"), codified at 29 C.F.R. 103.20–22,
rescinding an earlier rule the Board issued in April 2020 (the
"2020 Rule") that amended representation election
procedures.
As we previously reported, the Board
issued its Proposed Rule on this topic in November 2022, and then
received a number of comments during the comment period that ended
on February 2, 2023.

Chevron announced on Friday its plans to relocate its headquarters from Northern California to Houston, Texas. Chevron first began doing business in California nearly 150 years ago in 1879 with the incorporation of the Pacific Coast Oil Company, headquartered in San Francisco.

Earlier today (July 23, 2024), Judge Hodge in the U.S. District Court for the Eastern District of Pennsylvania denied a tree care company’s motion to stay the effective date and preliminarily enjoin the Federal Trade Commission’s (“FTC”) proposed final rule (“Final Rule”) banning nearly all non-competes. Since 2018, Proskauer has acted as pro bono legal counsel for a veteran who experienced racial discrimination during his service in the U.S. Marine Corps. Our client was stationed at Camp Pendleton in the mid-1970s. At that time, members of the Ku Klux Klan (“KKK”) served openly and actively at Camp Pendleton. As we’ve discussed previously (see here and here), the National Labor Relations Board (“NLRB”) has recently endeavored to work collaboratively with other federal agencies to combat workplace issues where multiple agencies may share jurisdiction. One such effort is the publication of a joint memo between the Equal Employment Opportunity Commission (“EEOC”) and the NLRB regarding picket-line speech that may be racially-charged.
