ESMA has published a consultation paper on the transaction data reporting and order book record keeping requirements introduced by Regulation (EU) 2024/791 (Updated MiFIR). This is the latest in a series of consultations published by ESMA as it fulfils its various mandates as part of the MIFID Review (see our briefing here) in light of Updated MiFIR entering into force (see our briefing here).

On 14 May 2024, ESMA published its final report on Guidelines on funds' names using ESG or sustainability-related terms (ESMA/34-472-440) (the "Guidelines"). This follows on from ESMA's original consultation (see our previous briefing here). The objective of the Guidelines is to combat greenwashing and ensure that where the name of funds indicate an ESG objective or criteria, the portfolio and investment process reflects that profile.

ESMA has published a statement on the use of AI systems by investment firms and relevant MIFID considerations. This appears to be the most detailed and significant statement so far by ESMA for investment firms in relation to this area, (although ESMA officials have published speeches on the increasing use of AI systems by investment firms and the importance of investor protection) and contains important information for firms.

Legislative amendments to MIFIR (Updated MiFIR) and MIFID (Updated MiFID) have been published in the Official Journal. The texts were introduced by the European Commission in November 2021 (see our briefing here).
