Many were taken by surprise when the Prime Minister announced that the long anticipated general election will be held earlier rather than later in the second half of 2024 – perhaps not least DLUHC itself. The department has been pro-actively pushing through the government's planning reforms pursuant to the Levelling Up and Regeneration Act (LURA) 2023. Just last month they announced that they would shortly consult on steps to implement provisions in the Act incentivising build-out.

Biodiversity net gain (BNG) for most major town and country
planning development came into effect earlier this week on Monday,
12 February 2024, subject to certain exceptions and exemptions
– for example, small sites will not have to deliver 10% BNG
until 2 April 2024 and requirement does not apply to permitted
development rights, de minimis development, certain self-build and
custom-built development and householder applications.

Last week, with the passing of the Environment Act 2021 (Commencement No 8 and
Transitional Provisions) Regulations 2024 (SI 2024/4), the
government confirmed that mandatory biodiversity gain will come
into effect for major development on 12 February 2024. The
requirement will apply to all town and planning act development
which is not exempt, on which see our Yule Blog here.

Today's theme of "4 calling birds" apparently
refers to "colly birds", the old English term for that
beloved songbird the blackbird. According to the results of the
RSPB's 2023 Big Garden Bird Watch, the blackbird remains one of
the UK's most common garden birds. Unfortunately, others
aren't faring so well – the RSPB says that bird numbers
have depleted by 38 million in the last 50 years.

On this 7th day of our 2023 Yule Blog, we consider the quality
and quantity of the water in which our swans are swimming. We take
a quick look at the impacts of nutrient and water neutrality in
2023 and consider whether we might see a change in 2024.
Back in September 2022, we wrote about the impact that nutrient pollution
in protected waters was having on housing development across large
parts of England as a consequence of Natural England's
"nutrient neutrality" guidance.
