Biodiversity net gain (BNG) for most major town and country planning development came into effect earlier this week on Monday, 12 February 2024, subject to certain exceptions and exemptions – for example, small sites will not have to deliver 10% BNG until 2 April 2024 and requirement does not apply to permitted development rights, de minimis development, certain self-build and custom-built development and householder applications.

Last week, with the passing of the Environment Act 2021 (Commencement No 8 and Transitional Provisions) Regulations 2024 (SI 2024/4), the government confirmed that mandatory biodiversity gain will come into effect for major development on 12 February 2024.
