The rising adoption of generative artificial intelligence (Gen AI) technology in the legal profession is having an impact on all areas of law firm operations, including staffing decisions. Nearly four in 10 (38%) of senior Am Law 200 lawyers say their firms are planning to hire technologists such as data scientists or engineers to support their Gen AI programs, according to the 2024 LexisNexis Investing in Legal Innovation Survey.

Before that can happen, lawyers and their clients need to develop trust in legal AI in the same way they trust an experienced associate. After pushback from attorneys, the U.S. Court of Appeals for the Fifth Circuit has discarded a proposed rule that would have required lawyers to disclose if they used generative AI in crafting a brief. If adopted, attorneys would have had to check a box confirming no AI program was used in drafting a filing or, if one was used, certify that it was reviewed for accuracy by a person. Attorneys who submitted comments said the proposal was unnecessary given existing federal rules.

A Fox Rothschild retirement dispute made its way into New Jersey state court on Wednesday, highlighting succession issues under mandatory retirement policies as well as the matter of senior attorney compensation. Former equity partner and corporate department chair Michael Kline filed suit against the firm and its former managing partner Mark Morris in Mercer County Superior Court alleging age discrimination after being forced into an income partner role at the firm in 2018 on hitting age 73.
