At the time of our last COP28 update, we were still waiting to hear
what the outcomes would be from several key discussion areas that
remained open, including the results of the first Global Stocktake
("GST").
After almost two weeks of fractious negotiations, an
eleventh-hour agreement known as the UAE Consensus (the
"Consensus") was signed by the almost
200 attending government representatives at COP28.

The EU and UK are both taking steps designed to safeguard the
supply of critical raw materials. These include rare earths, which
are essential for products that support the green energy
transition, such as batteries and the magnets in wind turbines.
The European Commission has released a draft of the 'Critical Raw
Materials Act' ("CRMA"). The purpose
of the CRMA is to ensure that the EU maintains access to a
resilient and sustainable supply of critical and/or strategic raw
materials.

The Energy Act 2023 (the "Energy
Act") received royal assent on 26 October 2023. It
represents one of the most significant changes to the UK's
energy legal landscape in recent years, including establishing a
new legal obligation for Ofgem to consider net zero targets when
exercising its duties and adopting a range of measures to
incentivise the development of new low-carbon energy
infrastructure.
