On February 18, 2025, the First Circuit joined a growing list of circuit courts to hold that “but-for causation” is the correct causation standard in most False Claims Act (FCA) cases premised on alleged violations of the Anti-Kickback Statute (AKS). In so holding, the Court rejected the U.S. Department of Justice’s (DOJ) argument that a more lenient, vague “causal connection” standard should apply.

On July 30th, Massachusetts bands 8th Grade Slowdance(8GSD) and Juniper Bends released a split EP entitled Slowbends. I had been following 8GSD since their first show because of their links with a band called Cabin Boy, and was unbelievably excited to hear their debut.

Since June 2023, the False Claims Act (FCA) bar has waited with baited breath for district courts to address Justice Thomas’s dissent in United States ex rel. Polansky v. Executive Health Resources, Inc., suggesting that the qui tam provisions of the federal civil False Claims Act – which allow a private citizen whistleblower or qui tam relator to file and pursue an FCA case even if the government declines to join or intervene in the suit – may be an unconstitutional delegation of power.
