Another ban from California: Say goodbye to most new gas-powered lawn and garden equipment

California is not just banning gas-powered vehicles and trying to ban diesel locomotives. The state is also banning the sale of new gas-powered small off-road engines (SOREs), such as gas-powered lawnmowers and other landscaping equipment, in an attempt to reduce carbon emissions. In 2021, the state legislature passed Assembly Bill 1346 which authorizes the California Air Resources Board (CARB) to issue regulations on SOREs. CARB has banned the sale of most new SOREs starting in 2024.

The Environmental Protection Agency’s (EPA) final rule on particulate matter prematurely makes the primary annual standard for fine particulate matter () much stricter. It does so even though parties likely to be subjected to regulation can do little to reduce overall PM2.5 emissions because they account for a small amount of existing emissions. Most of the emissions come from non-point sources, including wildland fires, which are generally difficult to address.

President Joe Biden signed the so-called Inflation Reduction Act (IRA) into law on August 16, 2022. The bill, enacted on a purely partisan basis, is filled with wasteful spending, central planning, and attacks on freedom. One program in particular deserves special attention: the Greenhouse Gas Reduction Fund (section 60103 of the IRA). Section 60103 amends the Clean Air Act and gives the Environmental Protection Agency (EPA) until September 30, 2024 to distribute $27 billion for “green” projects.
