Keep up to date with energy regulatory developments in Ireland
in our March energy horizon scanner. Current
developments include consultation on the RESS 4 auction, the
closing date of which is extended to 28 March 2024. In offshore
renewable energy development, two ongoing consultations look at
treatment of grid development costs (for merchant Phase 1 projects
and Phase 2 projects). We are also following development of the
EU's Nature Restoration Law as the Parliament agrees its
approach.

The Energy (Windfall Gains in the Energy Sector) (Cap
on Market Revenues) Act 2023 provided for certain entities
to make returns to the CRU not later than December 2023. The CRU
has now made Regulations setting out requirements in relation to
these returns: S.I. No. 86/2024 – Energy (Windfall Gains in
the Energy Sector) (Cap on Market Revenues) Act 2023 (Returns)
Regulations 2024.

The concept of double-entry accounting has been around for over five centuries. In 1494 an Italian monk named Luca Pacioli who was also an accomplished mathematician devised a process for keeping buying and selling among fifth century merchants equitable who did business with each other. He wrote a book on mathematics which included the double-entry postulation section which has provided the basis for all modern-day businesses who run their financial affairs.

In Ireland, Government policy supports economic growth and direct inward investment. This requires adequate electricity supply. Typically, this means that electricity producers and consumers can obtain a connection to the electricity grid. It is also possible for cables to be laid directly between producers and consumers and this is not unusual in many jurisdictions.

The Terms and Conditions and Timetable for RESS 3 are now available, with the qualification process opening on 30 May 2023. As suggested in the consultation, RESS 3 will provide for an Unrealised Available Energy Compensation (“UAEC”) with the intent of minimising the extent to which regulatory risk is factored into RESS auction bid prices. Compensation for constraints, however, is not included in the UAEC and DECC states that this is because constraints remain an important locational signal.
