In Killaree Lighting Services Limited("applicant") v Mayo County Council("respondent") and Electric SkylineLimited ("notice party"), the Court ofAppeal ([2025] IECA 7) largely upheld the HighCourt's conclusions ([2024] IEHC 79), albeit with points ofdifference, notably on the impact of the failure to send astandstill letter. The background was that the respondent raised concerns that theapplicant's tender included abnormally low amounts.

In Ireland, Phase 2 development of offshore renewable
energy is to take place off the South-East Coast. Unlike Phase 1,
Phase 2 is plan-led: the transmission system operator, EirGrid,
will develop grid assets to connect projects on State selected
sites.
In October 2024, some key building blocks for Phase 2 have been
put in place. They include Government approval of the South-Coast
Designated Maritime Area Plan and a Decision on Grid Connection
Policy.

guidance relates to implementation of the obligations imposed on
Member States under the revised Renewable Energy Directive.

with the qualification process opening on 20 May 2024.
The significant change in RESS 4 is the recognition that further

The European Commission has now published questions and answers
on Article 5 where many key, but not all, obligations on operators
of publicly accessible recharging points are concentrated.

The Alternative Fuels Infrastructure Regulation (EU)
2023/1804 applies from 13 April 2024. It
imposes obligations on operators, owners, mobility service
providers, and Member States. It builds significantly on Directive 2014/94/EU, repealed from 13 April
2024.
The 2014 Directive required all recharging points accessible to
the public to provide for the possibility for EV users to recharge
on an ad hoc basis without entering into a contract with the
electricity supplier or operator.

Keep up to date with energy regulatory developments in Ireland
in our March energy horizon scanner. Current
developments include consultation on the RESS 4 auction, the
closing date of which is extended to 28 March 2024. In offshore
renewable energy development, two ongoing consultations look at
treatment of grid development costs (for merchant Phase 1 projects
and Phase 2 projects). We are also following development of the
EU's Nature Restoration Law as the Parliament agrees its
approach.
