By Jeffrey GreeneRecently, I led a delegation of the Flying Tigers to China to attend an event to commemorate the 80th anniversary of the U.S. 14th Air Force’s participation in China’s war of resistance against Japanese aggression. We visited Beijing, Chongqing, Kunming, Liuzhou, and other cities. Among the members of our delegation were Flying Tigers veterans Harry Moyer and Melvin McMullen, as well as relatives and descendants of Flying Tigers veterans.

In a recent decision, the Workplace Relations Commission (WRC) found that the Sick Leave Act 2022 (Act) permits an employer to substitute more favourable sick pay terms for the statutory sick pay scheme under the Act, in circumstances where the employer’s terms are, as a whole, more beneficial to employees. This decision has brought an employer’s obligations under the Act into practical focus and serves as a welcome authority on the circumstances in which those obligations can be disapplied.

An order quashing a 2018 Sectoral Employment Order (SEO) for the Mechanical Engineering Building Services Contracting Sector, was granted by the High Court on 10 October 2023. The challenge to the SEO was brought by Allbrite Electrical and Mechanical Limited, along with the employer body APHCI. The challenge was based on a separate 2021 Supreme Court ruling of ultra vires in relation to similar pension provisions to those in the SEO.
