It's been just over a year since an incident in a Little Rock neighborhood left an agent with the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives injured and a prominent city employee dead. Bryan Malinowski was director of Little Rock’s Bill and Hillary Clinton National Airport when he was killed in a shootout while ATF agents executed a search warrant on his home.

An amendment to encode direct democracy in the Arkansas Constitution passed its first hurdle, thanks to an opinion from Attorney General Tim Griffin Wednesday. “An Amendment Concerning Constitutional Amendments, Initiated Acts, and Referendums” is supported by the League of Women Voters of Arkansas. It's a meta-amendment regarding the way the state constitution in Arkansas is itself amended. The language in the proposal serves to simplify the rules.

Two Arkansas groups are working to ensure citizens' right to amend the state constitution. Protect AR Rights and the League of Women Voters of Arkansas each want to put an amendment on the ballot strengthening the canvassing process altogether. The Arkansas Constitution has language guaranteeing the right of citizens to pass amendments and initiatives — this means any citizen can work through a process to put a proposal on the ballot for a vote.

A lawsuit about ballot access is gaining steam. The American Civil Liberties Union (ACLU) is now working with Arkansas Non-profits to fight strict new rules on canvassing. As Little Rock Public Radio reports, Arkansas’ constitution protects citizen-led ballot initiatives. But earlier this year legislators passed laws that advocates say make it nearly impossible to get initiatives on the ballot. This latest development followed previous legal fights over signature requirements for each county.
