On October 30, 2023, the U.S. Department of Health and Human Services (HHS) released a proposed rule (Proposed Rule) to establish disincentives for healthcare providers that engage in information blocking under the 21st Century Cures Act (Cures Act). Prior to issuing the Proposed Rule, healthcare providers were not subject to any specific penalties for failing to comply with the information blocking requirements under the Cures Act.
