Signed by Governor Pritzker, House Bill 3733 amends the Illinois Human Rights Act to specifically prohibit employers from using AI to discriminate in the recruitment, hiring, promotion, training, discipline, tenure, and discharge of workers. This may happen in a number of ways, including using an applicant’s zip code to screen for jobs as a way to preclude residents of predominately minority neighborhoods or emphasizing certain schools over others.

On May 1, Utah’s Artificial Intelligence Policy Act (“UAIPA”)took effect requiring certain disclosures regarding use of artificial intelligence (“AI”) systems, specifically generative AI. Signed by Governor Spencer Cox on March 13 as part of Utah’s consumer protection laws, the UAIPA joins other state-specific legislation (such as Colorado’s Consumer Protections for Interactions with AI law) targeted toward consumer-facing use of AI.

On May 17, 2024, Colorado Gov. Jared Polis signed into law SB 24-205, Consumer Protections for Interactions with Artificial Intelligence (the “Colorado AI Act”), making Colorado the first U.S. state to enact comprehensive legislation regarding the use and development of artificial intelligence (“AI”). The Colorado AI Act, which goes into effect Feb. 1, 2026, is designed to require deployers and developers of high-risk AI systems use reasonable care in preventing algorithmic discrimination.

The use of AI in the justice system and dispute resolution has become a significant topic of conversation. This suggests the first real legal limits on the technology may come from the courts instead of legislation. In one instance, a Washington state court barred the use of AI enhanced cellphone video as evidence in a murder trial. Similarly, New York State formed a panel to study how AI could improve access to justice while also exploring ways to avoid any potential risks associated with its use.
