The Trump administration doesn’t have to restore green grants to cities and nonprofits while its appeal from a district court order to do so is pending, a federal appeals panel ruled. The US Court of Appeals for the Fourth Circuit on Thursday granted the government’s motion to stay a permanent injunction to reinstate millions in grant funds on Thursday, finding the administration “is likely to succeed in showing that the district court lacked subject matter jurisdiction” under the Tucker Act.

A long-running dispute between professional players’ unions and Pittsburgh over a tax on visiting athletes gives the Pennsylvania Supreme Court an opportunity to more clearly define a state constitutional requirement that taxes be applied uniformly. Pittsburgh will ask the high court at oral arguments Thursday to overturn a 6-1 state appeals court opinion striking down the city’s 3% facilities fee for violating that provision.

The Eleventh Circuit is set to consider a constitutional challenge to the authority of US Tax Court judges, a case that attorneys say can help shape a line of rulings on the powers of nontraditional adjudicators. Taxpayer Fannie Wright will try to convince the US Court of Appeals for the Eleventh Circuit at oral arguments Thursday that the entire court system is invalid as part of her appeal from a Tax Court decision upholding $6,100 in deficiencies and penalties originally assessed by the IRS.
