Still reeling from the 2019 COVID pandemic, it was not until last year that the aviation industry’s passenger profitability firmly returned back to black. The aviation industry as a whole is now once again on the move, with total revenue expected to reach a record high of US $996 billion by the end of 2024. This strong growth is predominantly being pushed by an uptake in passenger demand with the total number of airline travellers expected to reach 4.96 billion in 2024 – another record high.

The imposition of sanctions has caused an explosion in the litigation between aircraft lessors and their insurers which may have been unintended.

In London Arbitration 14/23, the Tribunal was asked to consider whether the charterers had breached their warranty that in the ports to which the ship would be ordered, the vessel would always be afloat. The charter was for a one-time charter trip via the US Gulf to China. The vessel was delayed in berthing at New Orleans/Mississippi River due to the passage of Hurricane Ida and waited at Alliance Anchorage for 34 days. The vessel departed and was redelivered in China on 7 December 2021.

This World Maritime Day, we celebrate 50 years of MARPOL and the collective efforts of the international maritime community to protect our marine environment over the last 50 years. MARPOL was first adopted in 1973 to protect the marine environment and clean up the air and water in which we live. The convention was ‘one of a kind’ then, adopted after a series of oil and chemical tanker incidents resulted in significant amounts of pollution in our oceans.
