The Trump administration gave notice late Wednesday that it would appeal a Maryland federal judge’s order that it take “all available steps to facilitate” the return of an alleged MS-13 gang member to the US following his deportation to El Salvador. In addition to confirming that it would appeal Greenbelt District Judge Paula Xinis’ order, the Justice Department asked the Richmond, Va.-based Fourth Circuit Court of Appeals to immediately stay the lower court’s demand while the appeal is heard.

A Maryland federal judge who ordered the Trump administration to return an alleged MS-13 gang member wrongly deported to El Salvador last month ruled that she would not hold any government officials in contempt for violating her order — for now — but warned against further “gamesmanship.”“We have to give process to both sides. But we are going to move,” US District Judge Paula Xinis said at a hearing in her Greenbelt, Maryland, courtroom Tuesday afternoon.

The feds have done nothing to comply with court orders to make the El Salvador government return alleged MS-13 member Kilmar Abrego Garcia after he was wrongfully deported to the country’s hellhole CECOT prison,  his lawyers claimed ahead of a hearing in his case later Tuesday.

Mahmoud Khalil can be deported over his involvement in anti-Israel demonstrations at Columbia University, an immigration judge ruled Friday in the closely watched case. The ruling in Louisiana federal court came in the government’s bid to boot the Syrian-born permanent resident out of the US over his anti-Israel activism at Columbia. But Khalil won’t be deported immediately — his lawyers will get the chance to fight the proceedings before a final determination is made.
