In a judgment handed down on Wednesday 19 February 2025(Nasir v Zavarco Plc [2025] UKSC 5), theSupreme Court has held that the esoteric but longstanding doctrineof merger, which prevents a party from seeking any further reliefon a cause of action once a judgment has been given upon it, doesnot apply to declaratory judgments. In an extensive Judgment of over 200 pages, Mr Justice Henshaw rejected jurisdiction challenges brought by the Defendant international reinsurers on the basis of Russian exclusive jurisdiction clauses (EJCs). Finding that the mostly western owners and lessors of over 200 aircraft were very unlikely to receive a fair trial in Russia, he refused to order a stay of the English proceedings. The case is one of The Lawyer's Top 20 Cases of 2024.

Robert-Jan Temmink KC and Catherine Doran appeared in the Trinidad & Tobago Court of Appeal for the successful appellant. In a decision which will be relevant to certain other Commonwealth and former Commonwealth countries, the Court of Appeal rejected the University of West Indies' contention that the Court's jurisdiction had been ousted by the University Visitor.
