The Federal Trade Commission (FTC) recently announced a proposed rule that would bar noncompetes in most employment agreements. It’s unclear whether the rule will go into effect because the FTC’s authority to issue to do so will probably be challenged in court. Whatever the outcome, employers and employees alike may want to review their existing agreements to determine how they might be treated under the proposed rule, and whether those existing agreements would be enforceable.
