Data (31-page / 14.5MB PDF) from the Mumbai Centre for International Arbitration (MCIA) showed an increase of its caseload from 23 cases in 2023 to 34 in 2024, with the total value of cases reaching $257 million and an average value of $11.4m. International arbitration expert Mohammed Talib of Pinsent Masons said: “The release of MCIA’s 2024 Annual Report revealed a 48% increase in new cases and underscores the growing use of institutional arbitration in India”.

The LCIA recently published its biggest ever report – Costs and Duration Analysis 2024 – analysing the cost and duration of all LCIA arbitrations subject to a final award between 1 January 2017 and 12 May 2024. This report builds on previous editions from 2015 and 2017, marking the longest time period studied by the LCIA and any institution to date, allowing for a detailed and comparative analysis.

The proposed amendments come at a time when various Indian initiatives are being undertaken by arbitration stakeholders to enhance the country’s dispute resolution environment. The amendments aim to promote ease of doing business in India, helping to establish the country as a robust and reliable arbitration forum and prevent the further ‘exporting’ of arbitrations to countries like Singapore, which currently hosts a significant number of disputes involving Indian parties.
