After nearly three years of discussion and revision, China has officially released the finalised Network Data Security Management Regulations (Regulations), set to come into effect on 1 January 2025. recently released a consultation draft of the Administrative Measures on
the Reporting of Cybersecurity Incidents
(Measures), together with the Guidelines on

The Cyberspace Administration of China (CAC)
has released draft provisions which will relax the current
requirements on cross border data transfers. The draft provisions
set out exemptions from the need to comply with one of the three
transfer mechanisms that would otherwise be required, namely (i) CAC assessment (ii) China's standard contract or China standard
contractual clauses (China SCCs) ; or (iii) certification. The consultation period for the
draft provisions will end on 15 October 2023.

China's Standard Contract, also known as Standard Contract
Clauses (SCCs), is a legal instrument that enables
multinational corporations (MNCs) to transfer
personal data from China to other countries or regions. It is one
of the three legal mechanisms for cross-border data transfer under
Chinese data protection laws. A security assessment conducted by
the Cyberspace Administration of China (CAC) is
one of the other mechanisms and is mandatory if certain thresholds
are met.

Measures for Standard Contract for Outbound
Cross-border Transfer of Personal Data came into force on 1 June
2023
On 24 February 2023, the Cyberspace Administration of China (the
"CAC") issued the Measures for
Standard Contract for Outbound Cross-border Transfer of Personal
Data (the "Measures") and published
the Standard Contract for the Outbound Cross-border Transfer of
Personal Data (the "SCC"), which
came into force on 1 June 2023.
