After nearly three years of discussion and revision, China has officially released the finalised Network Data Security Management Regulations (Regulations), set to come into effect on 1 January 2025. The Regulations enhance and add to existing data protection laws and provide more comprehensive advice on how network data processors should handle personal information and important data, introducing stricter duties and penalties for non-compliance.

In 2023 the consumer sector M&A market experienced a
year-on-year 7% drop in deal volume and a 31% decline in deal
values. Unprecedented, once-in-a-generation macroeconomic factors
such as the war in Ukraine, stubbornly high inflation, raised
interest rates and increased scrutiny from regulators dampened
activity significantly. While not unique to the sector, the impact
of declining real incomes and consequent reduction in discretionary
spend had a major impact.

recently released a consultation draft of the Administrative Measures on
the Reporting of Cybersecurity Incidents
(Measures), together with the Guidelines on
Grading of Cybersecurity Incidents (Guidelines)

open for public comment until 7 January 2024.

China's Standard Contract, also known as Standard Contract
Clauses (SCCs), is a legal instrument that enables
multinational corporations (MNCs) to transfer
personal data from China to other countries or regions. It is one
of the three legal mechanisms for cross-border data transfer under
Chinese data protection laws. A security assessment conducted by
the Cyberspace Administration of China (CAC) is
one of the other mechanisms and is mandatory if certain thresholds
are met.
