On 1 April 2024 a press-release was published in CC titled: ‘Vested interests’ trying to influence judiciary’, 600 lawyers write to CJI.’ I was surprised – nay shocked – to see this press-release published in CC. The press-release gives no indication of its origin which in itself is worrying. This letter by 600 lawyers was given wide coverage in mainstream media; endorsed by PM Modi – which was also dutifully covered widely by mainstream media.

That the Indian judiciary has been in crisis, often its credibility being undermined, is well known. It is part of the all-round institutional degeneration, increasingly felt. More than 600 lawyers, including senior advocate Harish Salve and Bar Council of India chairperson Manan Kumar Mishra, have written to the Chief Justice of India, alleging that a “vested interest group” is trying to put pressure on the judiciary and defame courts “on the basis of frivolous logic and stale political agendas”.

Under the Constitution, Parliament is entrusted with the responsibility of making laws. At times an easier route to change the legal jurisprudence to sail with the interests of the establishment seems to be through the judiciary.  The Covid epidemic and the draconian powers under the Disaster Management Act were opportunistically used to repeal 29 legislations providing protection to workers like the Industrial Disputes Act, 1947, Factories Act and Minimum Wages Act.
