bill (Bill No. S03100/A1278B — An Act to Amend the
Labor Law, in Relation to Prohibiting Non-Compete Agreements and

same day, June 7, 2023, the New York Senate also passed Bill No. S6748 (the "Bill"), which
would similarly prohibit non-competes. The Bill aims to prevent
monopolies, monopsonies, and restraints on trade and classifies
non-competes as unfair, anti-competitive business practices. Id. at § 8(2).

would impose a blanket ban on employee non-competition agreements
in New York.
The Bill defines a "non-compete agreement" as:
any agreement, or clause contained in any agreement, between an
employer and a covered individual that prohibits or restricts such
covered individual from obtaining employment, after the conclusion
of employment with the employer included as a party to the
agreement.

Omnibus Jobs Bill SF 3035 (the "Bill"). The Bill has
significant implications for employers with employees in Minnesota
and includes numerous changes to Minnesota state law, including a
sweeping ban on non-compete agreements; a ban on mandatory
employer-sponsored meetings; newly mandated statewide paid sick
leave; and expanded protections for parental leave and pregnant
employees, among others.
